Our Family Law Services
Separation and Divorce
Separation can involve much more than the formal divorce process. Our Sydney family lawyers advise on parenting arrangements, property settlement, financial support, divorce applications and the practical steps required to protect your position following separation.
Parenting arrangements and child custody
We advise parents on parenting arrangements, parental decision-making, relocation, recovery applications, urgent proceedings and cases involving family violence or allegations of risk. Our focus is on achieving legally sound, practical and child-focused arrangements.
Property Settlement
Our family lawyers advise on the division of assets, liabilities, superannuation and financial resources following marriage or de facto separation. We have particular experience in complex and high-net worth matters involving companies, trusts, business interests, property portfolios, inheritances and international assets.
Spousal Maintenance
Spousal maintenance may be available where one party cannot adequately meet their reasonable expenses and the other has capacity to provide financial support. We advise both applicants and respondents on urgent, interim and final maintenance claims.
Child Support
We advise on child support assessments, private child support agreements, departure applications, enforcement issues and the treatment of school fees, medical costs and other significant expenses.
International Family Law
Family law matters involving more than one country can raise difficult questions about jurisdiction, overseas assets, relocation, child abduction and the recognition or enforcement of orders. We advise Australian and international clients on complex cross-border parenting and financial matters.
International Child Abduction
International child abduction matters require urgent and specialist advice. We assist with applications concerning the wrongful removal or retention of children, including matters arising under the Hague Convention.
Family and domestic violence
We provide confidential advice where family violence affects parenting arrangements, personal safety, property negotiations or court proceedings. Where appropriate, we work with counsellors, psychologists, social workers and other support professionals to help clients obtain coordinated assistance.

Frequently Asked Questions About Family Law
Look for a lawyer whose experience matches the issues in your matter—not simply someone who practises occasionally in family law. Relevant considerations include specialist accreditation, experience in parenting or financial proceedings, familiarity with mediation and litigation, and the lawyer’s ability to explain your options clearly. For complex matters, ask who will have strategic oversight of your case and whether the firm regularly deals with issues such as relocation, family violence, businesses, trusts or overseas assets. You should also understand how fees will be charged and who will perform the work. The first consultation is an opportunity to assess whether the lawyer’s strategy, communication style and approach are right for you.
Not necessarily. Many parenting and financial matters are resolved through direct negotiation, lawyer-assisted negotiation, collaborative law, mediation or family dispute resolution. An agreement may then be formalised through consent orders or, in appropriate financial matters, a binding financial agreement. A parenting plan can record an agreement but is not legally enforceable in the same way as parenting orders. Court proceedings may be necessary where agreement cannot be reached, disclosure is withheld, there are safety concerns or urgent orders are required. Before commencing most parenting proceedings, parties must ordinarily attempt family dispute resolution and obtain a certificate, unless an exemption applies—for example, because of urgency, family violence or child-abuse concerns.
Parenting arrangements are determined according to the child’s best interests. Relevant considerations include the safety of the child and their carers, any views expressed by the child, the child’s developmental, psychological, emotional and cultural needs, and each proposed carer’s capacity to meet those needs. The benefit of the child having relationships with parents and other significant people is also considered where it is safe to do so. There is no automatic entitlement to equal time and no longer a presumption of equal shared parental responsibility. Parents may reach an agreement through a parenting plan or consent orders. If they cannot agree, the Court can make parenting orders after considering the circumstances and evidence in that particular family.
There is no automatic 50/50 division of property following separation. The process ordinarily involves identifying and valuing the parties’ assets, liabilities, superannuation and financial resources; considering their financial and non-financial contributions; assessing their current and future circumstances; and determining whether the proposed outcome is just and equitable. Relevant circumstances can include income, earning capacity, health, care of children and, under reforms commencing in 2025, the economic effects of family violence where applicable. Both parties have continuing duties of full and frank financial disclosure. Property settlement can be resolved by negotiation, mediation, consent orders or court proceedings. The appropriate outcome depends on the evidence and circumstances of the individual relationship.
Yes, but the Court decides whether a matter warrants urgent consideration. Urgent parenting applications may involve immediate safety concerns, threatened relocation, withholding or removal of a child, recovery orders or imminent overseas travel. Urgent financial applications may concern the sale or dissipation of assets, access to funds, injunctions, occupancy of a home or immediate financial support. The application generally requires precisely drafted orders, an affidavit explaining the relevant facts and evidence establishing the urgency. In exceptional circumstances, orders may be sought without first notifying the other party. Because the procedure and evidence are important, legal advice should be obtained promptly. If anyone is in immediate danger, call 000 rather than waiting for a family-law appointment.
Yes. Norton Law Group advises on complex and high-value property settlements involving companies, trusts, business interests, professional practices, property portfolios, superannuation, inheritances, third-party interests and assets held in Australia or overseas. These matters often require careful financial disclosure, asset tracing, valuation evidence and advice about taxation or corporate structures. We can work with forensic accountants, valuers, financial advisers, tax specialists and other experts where their input is required. Our role is to identify the legal and commercial issues, develop an evidence-based strategy and pursue resolution through negotiation, mediation or litigation. Early advice can also help preserve relevant records and reduce the risk of assets being transferred, concealed or dissipated.
Potentially, yes. Norton Law Group acts in family law matters involving clients, former partners, children or assets located outside Australia. These cases can raise additional questions about jurisdiction, service of documents, overseas evidence, foreign property, enforceability of orders, international relocation and child abduction. Whether an Australian court can determine the matter depends on factors including the parties’ connection with Australia, the nature of the application and any proceedings already underway overseas. Conferences and much of the preparation can generally be conducted remotely. Because cross-border steps can affect jurisdiction or the available remedies, it is important to obtain advice before moving a child, commencing overseas proceedings or entering arrangements dealing with international assets.
The first consultation allows the lawyer to understand your circumstances, identify any urgent issues and provide preliminary advice about your options. You will usually be asked about the history of the relationship, children and current parenting arrangements, assets and liabilities, any existing agreements or court orders, family violence or risk concerns, and what you hope to achieve. Bringing a short chronology and relevant documents can help make the meeting more productive. The lawyer may recommend immediate steps, further disclosure, negotiation, mediation or court proceedings, depending on the situation. You should also receive information about likely next steps, responsibility for the work and how legal fees will be charged. Advice will necessarily depend on the information available at that stage.
Legal costs depend on the complexity of the issues, the level of conflict, the amount of correspondence and disclosure required, whether experts or barristers are engaged, and whether the matter resolves by agreement or proceeds to court. Straightforward work may sometimes be offered for a fixed fee, while negotiations, complex advice and litigation are commonly charged according to the time involved. Court filing fees, barristers, valuers, forensic accountants and other disbursements may be additional. Before substantive work begins, the firm should provide a costs agreement explaining how fees are calculated and, where possible, an estimate or range. Ask what work can be delegated, what may increase costs and how costs will be reviewed as the matter progresses.
