The Norton Law Group follows a clearly defined and transparent mediation process that supports parties from initial contact through to final agreement. Our process is designed to minimise conflict, encourage cooperation, and promote productive negotiation. While each case is unique, our mediation framework generally follows the steps below:

Accredited Specialists in Family Law

1. Initial Enquiry & Suitability Assessment

Your mediation journey begins with an initial consultation where we assess whether mediation is appropriate for your situation. This step includes screening for safety, urgency, or issues affecting suitability (including family violence considerations).

High Success Rate in Mediation Negotiation

2. Pre-Mediation
Preparation

Each party is provided with guidance on how to prepare, including collating relevant financial documents (for property matters) or key parenting considerations (for child-related matters). We clarify the issues in dispute and identify goals for the mediation session.

Personalised and Empathetic Approach

3. Agreement to Mediate & Confidentiality

Parties sign an Agreement to Mediate and a Confidentiality Agreement. This ensures all discussions remain protected, encouraging open and honest communication.

Comprehensive Legal Support

4. The Mediation Session

Mediation may be conducted as a joint session or via shuttle mediation (where parties remain in separate rooms or virtual breakout spaces). The mediator facilitates structured discussions, clarifies misunderstandings, and helps the parties identify options for settlement.

Client-Centred Communication

5. Negotiation & Option Developmentn

With the mediator’s guidance, both parties evaluate proposals and potential solutions. Our mediators ensure a balanced process, helping you navigate difficult issues constructively and respectfully.

Cost-Efficiency

6. Reaching Agreement

If agreement is reached, the mediator can assist in preparing a record of the terms agreed (often referred to as “Heads of Agreement” or a written summary). This document can then be taken to your legal representatives for advice and formalisation.

Comprehensive Legal Support

7. Making the Agreement Legally Binding

Your lawyers can convert the agreed terms into Consent Orders, a Parenting Plan, or a Binding Financial Agreement, depending on your circumstances. Our team supports this stage closely to ensure all outcomes are legally enforceable where required.

Our mediation process is flexible, child-focused, solution-oriented and designed to help parties move forward with confidence and clarity.

Independent Family Lawyer and Mediator

What is Mediation?

Mediation is a negotiation process in which the mediator (an independent family lawyer and mediator) assists the parties to identify and assess options and negotiate an agreement to resolve their dispute. Mediation is a non-judgmental process as all parties are treated equally with respect. The mediator is impartial. Although our mediators are specialist family lawyers , they do not provide legal advice as that is the role of the lawyers representing the parties. The role of the mediator is to open up and facilitate meaningful dialogue as can result in a resolution of the dispute.

Is a Mediation Agreement Legally Binding?

Any agreement reached at mediation is not a legally enforceable agreement, as any agreement reached will need to be formalised into a legally enforceable agreement or by way of Court Orders.

Is Mediation Confidential?

Mediation is by large a confidential process and each participant will need to sign a confidentiality agreement to ensure and protect confidentiality.

We always treat going to court as an absolute last resort. But, if going to court becomes unavoidable, we are prepared to see it through and fight tenaciously for your best interests.
