So, you’ve decided to get a divorce – what does the process actually entail?
You must have been separated from your spouse for at least 12 months to be eligible for a divorce. This is to allow time for you to consider your decision and make attempts at reconciliation.
Note: It is possible to complete the separation period while still living together, although this requires you to provide evidence you are functionally living apart and no longer in a romantic relationship.
Note: If you reconcile during the separation, after three months, your separation period requirements will reset.
Once you’ve passed the separation period, you can submit an application for divorce to the Federal Circuit and Family Court of Australia. The application needs to include your marriage certificate, citizenship status, and information about your separation (including disclosing any periods of reconciliation).

If your divorce application is accepted, then you can expect a court hearing between 4 to 8 weeks later. This hearing is typically conducted remotely and is especially important if you have children under 18, as the court needs to be satisfied that arrangements have been made for their welfare.

If the divorce is granted, it will officially come into effect one month and one day later when the court issues the Divorce Order (the document that legally dissolves your marriage).
Note: Even if your divorce has been granted, you cannot remarry until the Divorce Order is issued. If you remarry during this period, you will be committing bigamy, which is a criminal offence.
While getting granted a divorce marks the end of the official divorce process, it is usually only the beginning of your family law experience. The division of your assets and liabilities and the future care of children are both key issues that need to be resolved to the court’s satisfaction.
